HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN AND HON'BLE Dr. JUSTICE SHAMEEM AKTHER WRIT APPEAL No.396 OF 2017 JUDGMENT: (Per Hon'ble The Acting Chief Justice Ramesh Ranganathan) Sri Khader Mastan, learned counsel for the appellant, would fairly state that, in view of the law declared by the Supreme Court in Ram Kishan Fauji Vs. State of Haryana and others (Judgment in Civil Appeal No.4288 of 2017, dated 21.03.2017), the present appeal, preferred under Clause 15 of the Letters Patent, is not maintainable. Learned counsel would, however, request this Court to grant the appellant liberty to assail the order of the learned Single Judge in accordance with law.
As liberty was granted by the Supreme Court in Ram Kishan Fauji (supra), the present appeal is dismissed, as not maintainable, leaving it open to the appellant to assail the order of the learned Single Judge in accordance with law. As a sequel, pending miscellaneous petitions, if any, shall stand dismissed.
