HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.39684 OF 2016 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is filed by the petitioner invoking Article 226 of the Constitution of India seeking to declare the inaction of the 3rd respondent in disposing of the Revision Petition filed by the petitioner on 18.05.2015, as illegal and arbitrary. Heard the learned counsel for the petitioner as well as the learned Assistant Government Pleader for Revenue for respondents. With their consent, the writ petition is disposed of at the stage of admission itself.

The limited grievance of the petitioner is that on 18.05.2015 he filed a representation before the 3rd respondent-Joint Collector requesting to treat the same as revision under Section 9 of A.P. Rights in Land and Pattedar Pass Book Act, 1971, for rectification of revenue records. However, till date no orders are passed thereon.

Learned AGP would submit that the 3rd respondent may be directed to dispose of the revision, if the same is still pending consideration.

Considering the rival submissions made and since the revision filed by the petitioner is pending since May, 2015, the Writ Petition is disposed of directing the 3rd respondent-Joint Collector to dispose of the revision petition itself, in accordance with law,

after hearing the petitioner and all concerned, if any, within a period of eight weeks from the date of receipt of a copy of this order.

Miscellaneous petitions pending in this writ petition, if any, shall stand closed. No order as to costs.
