HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.31654 OF 2016 ORDER:

This writ petition is filed declaring the action of the 4th respondent in issuing the proceedings in Rc.No.A/ROR/213/2016, dated 24.03.2016, as illegal and arbitrary.

Learned counsel for the petitioner submits that the petitioner was not issued notice before passing the order dated 24.03.2016.

Learned Assistant Government Pleader for Revenue submits that the application of the petitioner was rejected by the 4th respondent on the ground that there are disputes between family members i.e., own brothers regarding partition of patta land and asked the petitioner to submit the application with proper registered partition deed. It is to be seen that liberty was granted to the petitioner to submit the application with all necessary documents.

In view of the same, it is open for the petitioner to make an application along with necessary documents in respect of his claim as observed in the order dated 24.03.2016 before the 4th respondent within a period of four (04) weeks from today. On such application being made by the petitioner, the 4th respondent is directed to

dispose of the same after issuing notice to the petitioner as well as affected parties.

With the above direction, the writ petition is disposed of. No costs. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. _________________________ A.RAJASHEKER REDDY,J 20-09-2016 dv
