THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION NO. 2615 OF 2017 ORDER:

This Criminal Petition under Sections 437 and 439 of the Code of Criminal Procedure, 1973 (for short 'Cr.P.C.'), is filed to enlarge the petitioner/ A-2 on bail in S.C.No.114 of 2016 on the file of the Special Judge for Trial of cases under the SCs and STs (POA) Act-cum-IV Additional District and Sessions Judge, Guntur.

The petitioner is in judicial custody since long time and entire investigation is completed, according to the petitioner, but he is languishing in jail.

The case of the prosecution is that this petitioner/ A-2 along with A-1 and A-3 kidnapped a boy, son of the de facto complainant and demanded huge amount for release of the boy and as the mother of the boy could not respond to their demand, they killed the boy and A-2 aided A-1, in killing the boy. Thus, allegedly the petitioner committed heinous murder of boy by kidnapping him. Therefore, completion of investigation, filing of charge sheet and registration of the Sessions Case is not a ground to enlarge the petitioner on bail. The petitioner also filed a similar application in Crl.P.No.249 of 2017 which was dismissed as withdrawn on 24.01.2017 and the present petition is renewal of said bail application without any changed circumstances. Therefore, I find no ground to enlarge the petitioner on bail at this stage. However, the Special Judge for Trial of cases under the SCs and STs (POA) Act-cum-IV Additional District and Sessions Judge, Guntur is directed to complete the trial and decide the case in accordance with law as expeditiously as

possible, preferably within six months from the date of receipt of a copy of this order.

With the above direction, the criminal petition is dismissed. Miscellaneous petitions, if any, pending in this petition, shall stand dismissed.
