THE HON'BLE SRI JUSTICE P.KESHAVA RAO WRIT PETITION NO.10425 OF 2015 ORDER:

There is no representation on behalf of the petitioners. The prayer sought in the writ petition is as under: "...............Writ of Mandamus, directing the respondents no.1 to 4 to take legal action on the complaint of the petitioners dated 15.10.2014 under Sec.3(1)(V) of SC & ST (POA) Act besides the other appropriate laws in force by registering a criminal case against the respondents No.5 to 7 for the offence committed and further direct them to forthwith restore the damaged graves in the graveyard situated in survey No.25/1 and 23/3 of Peeram Cheruvu Village, Rajendranagar Mangal, R.R.Dist, Telangana State, and pass such......."

During the course of hearing, the learned Government Pleader placed on record the written instructions dated 17.04.2015 issued by the Sub-Inspector of Police, Narsingi Police Station.

A perusal of the written instructions would reveal that as per the records, no complaint alleged to have been lodged by the petitioner on 06.09.2014 was received in their office till that date and as such no action was taken. It is also stated that from the perusal of the averments made in the affidavit filed in support of the writ petition, it appears that there is a dispute between the petitioners and the unofficial respondents 5 to 7 with regard to damage of grave yards in the subject land, which is purely civil in nature and the respondent-police is being dragged into litigation to wreck vengeance towards unofficial respondents.

In the light of the above facts, particularly the matter being civil in nature, this Court is of the opinion that there are no merits in the writ petition and the same is liable to be dismissed.

Accordingly, the writ petition is dismissed. No order as to costs.

Pending miscellaneous petitions, if any, shall also stand closed.
