THE HON'BLE SRI JUSTICE M. SATYANARAYANA MURTHY Crl.P.MP.No.910 OF 2017 in Crl.P.No.7117 of 2013 AND Crl.P.No.7117 OF 2013 ORDER:

The main Criminal Petition is filed under Section 482 of the Code of Criminal Procedure, 1973 (for short, 'Cr.P.C.') to call for the records relating to Crime No.793 of 2012, dated 13.10.2012 of KPHB Colony Police Station, Cyberabad, registered for the offence punishable under Section 498-A IPC and Sections 4 and 5 of the Dowry Prohibition Act and quash the same.

Crl.P.MP.No.910 of 2017 is filed under Section 320 (6) read with 482 Cr.P.C. to permit the parties to record compromise in the aforesaid crime.

The 2nd respondent/de facto complainant and petitioner Nos.1 and 2/A.2 and A.3 were present. Petitioner Nos. 3 and 4 are representing petitioner Nos.1 and 2 being General Power of Attorney. They are identified by their respective counsel. They also produced Photostat copies of Aadhar card in proof of their identity.

When the Court questioned about the compromise, the 2nd respondent informed that the matter is settled out of Court due to intervention of elders and petitioners agreed to pay an amount of Rs.15.00 lakhs and today an amount of Rs.7,50,000/- was paid by way of Demand Draft bearing

No.631181 to the 2nd respondent while agreeing to pay balance amount of Rs.7,50,000/- on the date of granting divorce in a petition proposed to be filed under Section 13-B of the Hindu Marriage Act, 1955.

In the affidavit filed in support of the petition, it is stated that in view of compromise entered into by both the parties due to intervention of elders and as per the terms of compromise, they intend to live separately, I find that it is a fit case to grant leave to compound the offences by exercising the jurisdiction under Section 320 (6) read with 482 Cr.P.C. 6.

Accordingly, Crl.P.M.P.No.910 of 2017 is allowed. Consequently, Crl.P.No.7117 of 2013 is allowed quashing the proceedings in Crime No.793 of 2012, dated 13.10.2012 of KPHB Colony Police Station, Cyberabad, registered for the offence punishable under Section 498-A IPC and Sections 4 and 5 of the Dowry Prohibition Act against the petitioners. Miscellaneous Petitions, if any, pending in this Criminal Petition, shall stand closed.
