THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM CIVIL REVISION PETITION No.5042 of 2018 ORDER:
The delay in disposal of I.A.No.299 of 2016 in O.S.No.123 of 2016 on the file of the Principal Junior Civil Judge's Court, Ananthapuramu, is questioned in this Civil Revision Petition. It is the case of the petitioners-defendant Nos.2 to 4 that adinterim injunction came to be granted on 22.02.2016 and though counter affidavit was filed, the enquiry in Interlocutory Application has not been completed and in the meanwhile, interim injunction is extended from time to time, which is causing prejudice to the defendants. The petitioners also had filed docket proceedings of this Court.
This Court does not find any justification in keeping the injunction petition pending for a period of two years. In those circumstances, learned Principal Junior Civil Judge, Ananthapuramu, shall pass appropriate orders on merits in I.A.No.299 of 2016 without any further delay, at any rate, within a period of six weeks from the date of receipt of a copy of this Order. Accordingly, the Civil Revision Petition is disposed of. No costs. As a sequel, pending miscellaneous petitions, if any, shall also stand closed.
