THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN AND THE HON'BLE SRI JUSTICE A.SHANKAR NARAYANA Writ Petition No.2054 of 2008 ORDER: (Per the Hon'ble The Acting Chief Justice Ramesh Ranganathan) The State preferred L.G.C.No.62 of 1998 before the Special Court under the Land Grabbing (Prohibition) Act, Hyderabad alleging that the land belongs them, and not to the petitioners. The Land Grabbing Court allowed the L.G.C. and held that the land belongs to the Government questioning which the petitioners filed W.P.No.3320 of 2006 which is pending on the file of this Court. The present writ petition is filed questioning the notice issued by the 1st respondent to remove/vacate the house in the possession of the petitioners which was the subject matter of the L.G.C. before the Land Grabbing Court.
The very fact that the jurisdiction of this Court was invoked in W.P.No.3320 of 2006, against the order of the L.G. Court, is based on the premise that the petitioners are not in possession of the land. No interim order was passed in the writ petition. The cause in the writ petition, therefore, does not survive, and the writ petition has become infructuous.
The Writ Petition is, accordingly, dismissed as infructuous. Miscellaneous petitions pending, if any, shall also stand dismissed. There shall be no order as to costs.
