THE HON'BLE SRI JUSTICE S. RAVI KUMAR Tr.CMP.No.644 of 2015 ORDER:

This application is filed to withdraw O.P.No.684/2015 from Family Court, Secunderabad and transfer the same to Family Court, Visakhapatnam.

2. Wife filed this application and according to her affidavit, respondent filed O.P.No.684/2015 at Secunderabad purposefully to harass her. She stated that she has been working at Visakhapatnam as a private employee and it is difficult for her to participate in the legal proceedings at Secunderabad by leaving her minor son.

She also contended that the respondent herein is doing business at Hyderabad and he cannot have any difficulty in attending the Family Court at Visakhapatnam and for these reasons, she prayed for transfer of O.P., from Secunderabad to Visakhapatnam.

3. This Court directed the petitioner to take personal notice to respondent through Registered Post With Acknowledgment Due and in compliance of the said order, notice was sent to respondent through Registered Post and postal acknowledgment of respondent is filed according to

which, the respondent received the notice in the month of November-2015. In spite of service of notice, the respondent neither appeared in person nor through any advocate.

4. Considering the reasons stated in the affidavit, request of the wife for transfer of O.P.No.684/2015 from Secunderabad to Visakhapatnam is ordered.

5. Accordingly, petition is allowed and O.P.No.684/2015 is withdrawn from Family Court, Secunderabad and transferred to Family Court, Visakhapatnam for disposal in accordance with law. No costs.

6. As a sequel, miscellaneous petitions, if any, pending in this Tr.CMP., shall stand disposed of.
