THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.24246 OF 2016 ORDER :

This writ petition is filed seeking writ of mandamus declaring the inaction of the respondents in not completing the constructions of houses in the lands of the petitioners in Sy.Nos.608/J and 608/D situated at Mulkanoor Village, Chigurimamidi Mandal, Karimnagar on the ground that the names of the petitioners were mentioned in the affidavit filed by the 5th respondent in W.P.No.17004/2016 (though not the parties) as illegal and arbitrary and consequently to direct the respondents to complete the construction of houses in the lands of the petitioners, who were beneficiaries under two bed room scheme.

Heard learned counsel for the petitioner and learned Assistant Government Pleader for Revenue.

In the counter affidavit filed by the 4th respondent in W.P.No.17004 of 2016, it is mentioned as follows: "6. In reply to para 9, it is submitted that the allegation of the petitoenr that constructions are being taken up in petitioner's land is not correct. The housing to the beneficiaries has been taken up in the lands owned by them. The writ petitioner is having land in Sy.No.608/F, H.I but the constructions are taken up in Sy.No.608/D.J to which the writ petitioner cannot have any objection. Hence, the writ petition filed by the petitioner is misconceived and untenable."

Recording the averments in the counter affidavit of the 4th respondent in W.P.No.17004 of 2016, this writ petition is disposed of. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in this writ petition, shall stands closed.
