THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.12424 OF 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/accused No.2 in Crime No.431 of 2023, on the file of Medchal Police Station, Medchal-Malkajgiri District, registered for the offence punishable under Sections 8 (c) r/w 20 (b) (ii) (C) of NDPS Act, 1985.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent-State and perused the record.

The Police Medchal on 25.06.2023 conducted check and recovered 210 kgs. of ganja from A-4. Thereafter, during the course of investigation, the name of this petitioner was revealed by the arrested accused. Pursuant to his confession, this petitioner was also taken into custody on 04.11.2023.

Learned counsel appearing for the petitioner would submit that apart from confession, there is no other material to connect this petitioner with the alleged crime. 5.

Learned Additional Public Prosecutor would submit that the case is under investigation and as on date only confession of A-4 is available.

This Court in Crl.P.No.9281 of 2023 granted the relief of regular bail to A-4 on the ground of violation of directions of the Hon'ble Supreme Court in Union of India v. Mohan Lal and Another1.

In the said circumstances, the, the relief of regular bail can be considered, subject to following conditions: i) The petitioner/accused No.2 shall execute personal bond for a sum of Rs.50,000/- (Rupees Fifty thousand only) with two sureties, for a like sum each to the satisfaction of IX Additional Metropolitan Magistrate at Medchal, Cyberabad.

ii) The petitioner/accused No.2 after release shall appear before the concerned Station House Officer at 10:00 a.m. on every Monday for a period of eight 1 (2016) 3 SSC 379

weeks and thereafter, as and when required for the purpose of investigation.

iii) The petitioner/accused No.2 shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C.

Accordingly, this Criminal Petition is allowed.

Miscellaneous applications, pending if any, shall stand closed.
