Heard Mr. Ch.Ravinder, counsel for the petitioner and the Assistant Government Pleader for Home for respondents..
Petitioners have grievance against respondents, particularly with the action of respondents 4 and 5 in interfering with the parking of taxi cabs at Charminar taxi stand. 5th respondent has filed counter affidavit and particularly stated that they are not interfering.
Be that as it may. This court is of the view that parking of vehicles, traffic regulations, etc., are matters of primary concern of police and public. There cannot be a general direction to the respondents to do a particular act or refrain from doing what is otherwise required at a given moment. This court is of the view that the petitioners, if have a grievance in the matter of parking of cabs / cars, in and around Charminar, can take up the grievance with 3rd respondent and this court has no reason to doubt that the 3rd respondent will examine said grievance in a comprehensive way and pass orders as are required in the facts and circumstances of a location. Hence, I am satisfied that this writ petition can be disposed of accordingly.
On the grievance canvassed in the writ petition and for any other grievances the petitioners have in the matter of parking at Charminar or in and around Charminar, they are given liberty to represent to 3rd respondent and the said respondent is to examine the grievance and pass a comprehensive order.
The writ petition is accordingly disposed of. No order as to costs. Miscellaneous petitions pending if any, shall stand closed. ------------------------------------------ S.V.BHATT,J DATE:25-04-2017 AVS
