Heard the learned counsel for the petitioner and the learned Government Pleader for the respondents.
The petitioner was appointed as fair price shop dealer of shop No.35 of Pillavalasa village, Ponduru Mandal, Srikakulam District. While so, on 18.03.2014, the Revenue Officials along with Vigilance and Enforcement Officials inspected the petitioner's shop, and on the basis of the report submitted by the 4th respondent, the 2nd respondent suspended the authorization of the petitioner by order dated 06.04.2014. Against the same, the petitioner preferred an appeal to the 3rd respondent. When the 3rd respondent did not pass any orders, the petitioner filed W.P.No.16113 of 2014 and this Court by order dated 12.06.2014 directed the 3rd respondent to dispose of the appeal within a period of six weeks from the said date. Now the 3rd respondent disposed of the appeal by order dated 02.02.2015.
Challenging the same, the present writ petition is filed. The 2nd respondent passed an order of suspension on 06.04.2014 pending enquiry and the pendency of appeal against the said order before the 3rd respondent should not have come in the way of the 2nd respondent in completing the enquiry. Even after one year, the 2nd respondent did not complete the enquiry. Even though the petitioner filed a revision against the order of the 3rd respondent dated 02.02.
of this order.
With the above direction, this writ petition is disposed of. There shall be no order as to costs. As a sequel, miscellaneous petitions, if any pending in this writ petition, shall stand closed. _________________________ A.RAMALINGESWARA RAO, J Date: 16.07.2015 siva
