ORDER:

This writ petition is filed for a mandamus to set aside the proceedings, dated 30.11.2011 of respondent No.1, whereby while declining to suspend the proceedings, dated 25.07.2011 of respondent No.2, he has directed respondent No.2 to complete the enquiry and pass a final order. A perusal of the record shows that this Court on 23.12.2011, while admitting the writ petition, suspended the impugned order in W.P.M.P.No.42263 of 2011. At the hearing, it is not disputed by any of the learned counsel for the

respondents that on the strength of the aforesaid interim order of this Court, the petitioner is being continued as the fair price shop dealer. Inasmuch as the proceedings initiated by respondent No.2 are pending, it is appropriate that respondent No.2 completes the enquiry pending before him and passes a final order and the petitioner is continued as the fair price shop dealer till such exercise is completed.

Accordingly, respondent No.2 is directed to complete the enquiry and pass a final order within three months from the date of receipt of a copy of this order. Till a final order is passed, the petitioner shall be allowed to continue as the fair price shop dealer.

Subject to the above directions, the Writ Petition is disposed of. As a sequel to disposal of the writ petition, interim order, dated 23.12.2011, in W.P.M.P.No.42263 of 2011 is vacated and W.P.M.P.No.42263 of 2011 and W.V.M.P.No.241 of 2012 shall stand disposed of as infructuous. __________________________ C.V.NAGARJUNA REDDY, J 10th June, 2015 GHN
