This criminal petition is filed under Section 482 Cr.P.C. seeking to direct the II Metropolitan Magistate, Cyberabad at L.B.Nagar to provide reasonable time to the petitioners for submission of all relevant documents and commencement of trial in D.V.C.No.5 of 2016. Heard learned counsel for the petitioners and learned Public Prosecutor appearing for the State.
Learned counsel for the petitioners submitted that the respondent No.2 herein, who is the husband of the 1st petitioner filed Crl.P.No.8491 of 2016, this Court disposed of the same on 20.06.2016 directing the learned trial Court to dispose of D.V.C.No.5 of 2016 within a period of three months from that day and that the respondent filed the said order copy on 22.08.2016 before the trial Court and that as per the said orders, learned magistrate insisted the petitioner for commencement of trial on the same day without giving any opportunity to secure the relevant documents and also submitted that the petitioners need some more time to produce her evidence, but the trial Court has not given any such time.
In that view of the matter, the criminal petition is disposed of directing the learned II Metropolitan Magistrate, Cyberabad at L.B.Nagar to dispose of D.V.C by end of December, 2016 to the extent modifying order dated 20.06.2016 passed in Crl.P.No.8491 of 2016.
