HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE AND HON'BLE SRI JUSTICE S.V. BHATT WRIT APPEAL No. 549 OF 2015 PC: (per the Hon'ble the Acting Chief Justice Dilip B. Bhosale) Heard learned counsel for the appellant and Sri D. Ramesh, learned Government Pleader for respondent No.1. This writ appeal is directed against the order dated 04.06.2015 passed in W.P.No.15604 of 2015, whereby the petition has been dismissed on the ground that the petitioner has an alternative remedy of appeal against the order dated 02.05.2015 passed by the Tahsildar. In the writ petition, the petitioner impugned order of the Tahsildar, dated 02.05.2015. It is not in dispute that an appeal is provided against such order under the provisions of the Andhra Pradesh Assigned Lands (Prohibition of Transfers) Act, 1977.
In view thereof, we are not inclined to entertain this appeal and in our opinion learned Judge has also rightly dismissed the writ petition. We, however, observe that if the appellant files appeal against the order dated 02.05.2015 passed by the Tahsildar within a period of two weeks from today, the appellate authority shall endeavor to consider and decide the same as expeditiously as possible and preferably within a period of twelve weeks from the date of filing of the appeal. It is needless to mention that the appellate authority shall consider and decide the appeal on merits in accordance with law and uninfluenced by the orders passed in the writ petition and this appeal.
merits of the case. It is also open to the appellant to make an application for appropriate interim order and if any such application is made, we hope and trust, the appellate authority shall consider and decide the same on merits in accordance with law expeditiously. With these observations, the writ appeal is dismissed. Miscellaneous petitions, if any, also stand dismissed. ________________________ DILIP B. BHOSALE, ACJ ________________________ S.V.
