Heard the learned counsel for petitioner, learned Government Pleader for Municipal Administration and Urban Development, Sri N.Praveen Kumar, learned counsel appearing for respondent No.2 and the learned counsel appearing for 3rd respondent. The grievance of the petitioner in the present writ petition is that despite issuing notice to the unofficial respondent herein, for removal of deviations under Section 217 of the Telangana Municipality Act, 1965 (for short 'the Act'), no further action has been taken by the respondents.
The material on record discloses that vide letter U.C.No.G1/UC/23/2018, dated 11.07.2018, the Commissioner, Korutla Municipality directed the unofficial respondent herein to remove the deviations.
Today, when the matter is taken, it is submitted by the learned counsel appearing for 3rd respondent that as against the above letter dated 11.07.2018, the 3rd respondent preferred appeal before the Municipal Council under Section 345 of the Act and the said appeal is pending.
Having heard the learned counsel appearing for both the parties, as the appeal dated 01.10.2018 is pending before the Municipal Council as per the learned counsel for the petitioner, this Court deems it appropriate to direct the respondent authorities to
pass orders on the said appeal dated 01.10.018 as expeditiously as possible, preferably within a period of four weeks from the date of receipt of copy of this order, after hearing all the parties. In the meantime, no further constructions shall be made by the 3rd respondent. No order as to costs.
Consequently, miscellaneous petitions pending, if any, shall stand dismissed.
