HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 24698 of 2017 ORDER:

1) The inaction of the respondents in not allotting the students under the Foreign National/ OCI/ PIO category to the second petitioner's institution in spite of the orders passed by AICTE and this Court, is subject matter of dispute in the present writ petition.

2) Earlier, the petitioners filed W.P.No.23706 of 2017 questioning the action of the first respondent in reducing the intake of the petitioners' institution. In the said writ petition it was averred that the respondents directed reduction of intake by 25% for the academic year 2017-2017 in view of the allegations made with regard to illegality and excess admission undertaken by them. Aggrieved by the same, the petitioners preferred an appeal which was allowed on 22.04.2017. In view of the order passed by the appellate authority, the writ petition was closed on 20.07.2017.

3) The grievance of the petitioners now is that in spite of the orders passed by the AICTE and the orders passed by this Court, the respondents are not allotting the students to the second petitioner institution.

4) Learned Standing Counsel appearing for respondent No.3University, on instructions, submits that if the students are

available under the categories referred to above, the University shall allot the students to the second petitioner's college in accordance with the procedure established under law. 5) Recording the said submission, the writ petition is disposed of directing the third respondent-University to allot students to the second petitioner's institution under the categories of Foreign National/ OCI/ PIO category, if the students under the said category are available, in accordance with law. 6) There shall be no order as to costs. Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
