THE HONOURABLE SMT JUSTICE K. SUJANA CRIMINAL PETITION No.13574 of 2025 ORDER:
This Criminal Petition is filed for grant of pre-arrest bail to the petitioners who are arrayed as accused Nos.13, 15, 16, 17, 18, 19, 20, 21, 24, 25, 26 and 27 in Crime No.178/2025 before the Medlachervu Police, Suryapet District, registered for the offences punishable under Sections 329(4), 118(1), 352, 351(2), 189(2) of BNS, and Sections 3(1)(r)(s), 3(2)(va) of SC/ST (POA) Act. 2.
The brief facts of the case of case are that the complainant, Bhuya Pedababu, a Government teacher, alleged that on September 19, 2025, at around 7:30 pm, a group of people from Yerragattu Thanda Village and Bojjagudem Village, including individuals from Reddy, Yadav, and Lambada castes, trespassed into his house, attacked him and his family members with sticks, and caused serious injuries, including fractures and swelling, with the intention of killing them. The complainant further alleged that the accused persons, including petitioners,
who were allegedly instigated by Bhavaneni Rambabu, a creditor, were trying to force them to join the Congress party, provide financial support for a brothel house, and vacate the village. On receipt of the said complaint, a case was registered against the accused persons.

Heard Mr.
N.Yashwanth, learned counsel for petitioner, and Mr. D.Arun Kumar, learned Additional Public Prosecutor appearing on behalf of the respondents - State.

Learned counsel for the petitioners submitted that the petitioners are innocent of the alleged offences and are no way connected to the crime. He asserted that petitioners are law abiding citizens with no criminal antecedents. While advocating that petitioners shall cooperate with the investigating agency, he prayed the Court to grant prearrest bail to the petitioners by allowing this criminal petition.

On the other hand, learned Additional Public Prosecutor vehemently opposed the submissions made by
the learned counsel for the petitioners, stating that there are specific set of allegations against the petitioners, and the custodial interrogation of petitioners is necessary. Therefore, prayed this Court to dismiss the criminal petition.

Having regard to rival submissions made and on going through the material placed on record, it is noted that in relation to petitioner Nos.1 to 5/accused Nos.13, 15, 16, 17 and 18, the offences punishable under Sections 3(1)(r)(s), 3(2)(va) of SC/ST (POA) Act seem to be applicable. That being so, at this stage this Court is not inclined to grant the relief of anticipatory bail to petitioner Nos.1 to 5/accused Nos.13, 15, 16, 17 and 18. However, keeping in mind the facts and circumstances of this case in entirety, this Court deems it fit to grant pre-arrest bail to petitioner Nos.6 to 12/accused Nos.19, 20, 21, 24, 25, 26 and 27, subject to compliance of the following conditions: i.
The petitioner Nos.6 to 12 shall surrender before the Station House Officer, Medlachervu Police Station, Suryapet District, within two weeks from today, and on such surrender, the said Station House
Officer shall release them on bail, on them executing a personal bond for Rs.25,000/- each (Rupees Twenty Five Thousand only), with two sureties, for the like sum each.
ii.
The petitioner Nos.6 to 12 shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and co-operate with the Investigating Officer in investigating the case.
iii.
The petitioner Nos.6 to 12 shall appear before the concerned Investigating Officer on every Wednesday between 09:00 a.m, and 05:00 p.m., till the filing of the charge sheet and thereafter, as and when required.

Accordingly, this Criminal Petition is partly allowed, granting the relief of anticipatory bail to petitioner Nos.6 to 12.
Miscellaneous applications, if any pending, shall stand closed.
