HON'BLE SRI JUSTICE M. SATYANARAYANA MURTHY CIVIL REVISION PETITION No.5178 of 2013 ORDER:

This Civil Revision Petition under Section 227 of the Constitution of India is filed challenging the Docket Order dt.25.11.2013 in C.M.A.No.48 of 2011 passed by the Principal District Judge, Warangal allowing the appeal, setting aside the decree and order in I.A.No.322 of 2009 in O.S.No.195 of 2009 dated 01.07.2009 passed by the II Additional Junior Civil Judge, Warangal. The petition filed under Order XXXIX Rules1 and 2 CPC before the trial Court was dismissed vacating the ex parte temporary injunction granted on 02.03.2009. Later an appeal was preferred and the same was allowed by the impugned order dt.25.11.2013. But, the suit was disposed of on 25.09.2014. Therefore, the interim order granted by this Court is merged in the impugned order. Therefore, nothing remained for adjudication in this revision. Hence, the revision petition has become infructuous and dismissed accordingly. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this petition shall stand closed.
