THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.29846 OF 2015 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is filed for the following relief:

"to issue a writ of Mandamus declaring the action of the respondents in not considering petitioner application for issuance of the caste certificate under SC "B" Category as illegal, improper, unjust and contrary to law and direct the respondents to dispose of his representation dated 03.07.2015."

2. Petitioner herein claims to be a permanent resident of Piddempalli Village, Damaragidda Mandal. Mahabubnagar District and he belongs to Madiga by caste. It is stated that he studied Secondary Education at Methodist High School at Chandrakal and completed Intermediate Education from M.B.C. Junior College and now prosecuting 2nd year B.Sc., at Government Boys College, Vanaparthy. It is further stated that after conducting detailed enquiry, the then Tahsildar issued a caste certificate certifying that the petitioner belongs to Scheduled Caste. It is further stated that after bifurcation of State, the authorities asked the petitioner to produce latest caste certificate from the concerned authorities. In view of the same, the petitioner claims to have submitted an application in the prescribed form along with relevant documents to the 4th respondent -Tahsildar, Damaragidda Mandal, Mahaboobnagar District.

It is submitted by learned counsel for the petitioner herein that even though the petitioner submitted an application long back on 03.07.2015, no action has been taken on the said application by the 4th respondent and because of the said inaction the petitioner is suffering undue hardship and irreparable loss.

4. Taking into consideration the totality of the circumstances and having regard the

nature of controversy, this court is of the considered opinion that the interest of justice would be met, if a direction is issued to the 4th respondent herein to take appropriate action on the application, dated 03.07.2015, said to have been submitted by the petitioner for issuance of caste certificate by fixing some time frame.

5. For the aforesaid reasons, the writ petition stands disposed of, directing the 4th respondent-Tahsildar to take appropriate action on the application, dated 03.07.2015, said to have been submitted by the petitioner and pass appropriate orders within a period of three (3) months from the date of receipt of a copy of this order. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
