THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR C.R.P. NO. 303 of 2016 ORDER:
Heard learned counsel for the petitioners.
This revision petition is preferred by the plaintiffs in O.S.No. 77 of 2015 on the file of Junior Civil Judge, Palamaner. In the said suit I.A.No. 448 of 2015 was filed by the plaintiffs seeking temporary injunction restraining interference by the defendants.
The grievance of the petitioners in this revision petition is that in spite of urgency involved in hearing of the interlocutory application for temporary injunction, it is not being taken up by the trial Court. The learned counsel for the petitioners states that the said application is now posted to 15.2.2016 and notices to the defendants have been served and counter-affidavit has also been filed on their behalf in the said application.
If the counter-affidavit is already filed on behalf of the defendants, the interlocutory application appears to be ripe for hearing and in view of the urgency expressed by
the petitioners, I deem it appropriate to direct the trial Court to hear and dispose of I.A.No. 448 of 2015 on 15.2.2016 to which date it is posted or at least on the next date of hearing and pass appropriate orders expeditiously. The revision petition is accordingly disposed of. Miscellaneous applications, if any, shall stand closed. No order as to costs.
