THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.19775 of 2016 ORDER:

Heard learned counsel appearing for both parties. With the consent of counsel appearing for both sides, the present Writ Petition is disposed of at the admission stage.

2. The present Writ Petition came to be filed seeking to declare the action of respondents 3 to 5 in not disposing the application, dated 27.08.2007, of the petitioner for grant of Quarry lease for Road Metal and Gravel in survey No.47 of G.Kondur Village and Mandal, Krishna District, as per the provisions of the APMMC Rules, 1966 and the guidelines issued in G.O.Ms.No.181 Ind &Com (Mines-I) Dept., dated 28.05.1998 and G.O.Ms.No.2 Rev (Assnt-I) Dept., 02.01.2013, as illegal and arbitrary and consequently direct respondents 3 to 5 to dispose of the said application as per rules within a period of one month as fixed by this Court.

3. Though various grounds raised in the Writ Petition, learned counsel for the petitioner restricts his prayer seeking a direction to respondent Nos.3 to 5 to dispose of the application, dated 27.08.2007, filed by the petitioner for grant of Quarry lease for Road Metal and Gravel.

4. Learned Government Pleader appearing for the respondents submits that the application filed by the petitioner is pending and the same shall be dealt with in accordance with law.

Having regard to the above and without going into the merits of the case, the Writ Petition is disposed of directing respondent Nos.3 to 5 to consider the application, dated 27.08.2007, filed by the petitioner and pass appropriate orders in accordance with law, as early as possible, preferably within a period of four (4) weeks from the date of receipt of a copy of this order. There shall be no order as to costs. Miscellaneous
