Heard learned counsel for the petitioner and learned Assistant Government Pleader for Revenue. With the consent of counsel appearing for both sides, the present Writ Petition is disposed of at the stage of admission.

Since this Court is not going into the merits of the case, issuing notice to respondent No.5 may not be necessary. 3.

This Writ Petition, under Article 226 of the Constitution of India, is filed seeking the following relief:

"to issue writ of Mandamus or any other appropriate writ, order or direction declaring that impugned Report Rc.No.B/530/2014, dated 26.03.2016 of Respondent No.5 herein in respect of Land extent of Ac.1.00 Guntas in Sy No.5/130 situated at Nazrul Nagar Village, Mandal Kaghaznagar, Asifabad (Old District Adilabad) Komaram Bheem District, Telangana State is illegal, arbitrary, unconstitutional, motivated, unwarranted, unsustainable and against law as well as principles of natural justice and consequently direct the respondent Nos.3 to 5 restore petitioner physical possession of the property by directing the Respondent Nos.3 to 4 to pass orders on merits in petitioner appeal No.1454 of 2015 dated 21.12.2015."

Though various grounds are raised, learned counsel for the petitioner submits that a direction may be given to 4th respondent i.e., the Sub Collector/Revenue Divisional Officer, Kaghaznagar Revenue Division, Asifabad District , Telangana District, to dispose of the Appeal No.1454 of 2015, dated 21.12.2015, filed by the petitioner preferred against the orders of the Tahsildar, Kaghaznagar, Asifabad District vide proceedings No.B/530/2014, dt.24.11.2015.

Learned Assistant Government Pleader for Revenue stated no objection for the same, provided the said appeal is still pending. 6.

Recording the said submission, the Writ Petition is disposed of directing the 4th respondent-Sub-Collector/Revenue Divisional Officer, Kaghaznagar Revenue Division, Asifabad District, Telangana District, to dispose of Appeal No.1454 of 2015, dated 21.12.2015, filed by the petitioner preferred against the orders of the Tahsildar, Kaghaznagar, Asifabad District, vide proceedings No.B/530/2014, dt.24.11.2015, as early as possible, preferably within a period of eight (08) weeks from the date of receipt of a copy of this order. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
