THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.1191 OF 2016 ORDER:
This criminal petition under Section 438 of the Code of Criminal Procedure is filed by the petitioner/A.1 seeking grant of anticipatory bail in connection with crime No.103 of 2015 on the file of the Jetprole (Veepangandla) Police Station, Mahabubnagar, Mahabubnagar District, registered for the offences under Sections 429, 436 IPC and Section 3(1)(x) and 3(2)(v) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989. Heard and perused the records.
The allegation against the petitioner herein is that the petitioner abused the de facto complainant in the name of the caste. Learned counsel for the petitioner submits that the petitioner has not committed any offence and he is a law abiding citizen and that he is ready to cooperate with the investigating agency. Hence, he prays this Court to grant anticipatory bail to the petitioner/accused.
This Court is of the view that even though the offences alleged against the petitioner herein is not so serious in nature, there is a bar for grant of anticipatory bail in the cases under Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.
Considering the above, the petitioner/A.1 is directed to approach the Court below by filing an application and on such filing, the Court below is directed to dispose of the application on the same day.
