HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.3840 OF 2017 ORDER:

The case of the petitioners is that they have filed an appeal on 06.01.2017 along with stay application before the 3rd respondent against the endorsement bearing Reference No.A/1868/2016, dated 12.09.2016 issued by the 4th respondent. The 3rd respondent having acknowledged the appeal has not passed any orders either in the stay application or in the appeal so far. Meanwhile, the respondents are trying to dispossess the petitioners. Aggrieved by the same, the present writ petition is filed.

Heard the learned counsel for the petitioners and the learned Assistant Government Pleader for Revenue.

In view of the above facts and circumstances, the 3rd respondent is directed to dispose of the appeal filed by the petitioners in accordance with law, after issuing notice to the affected parties. Even, according to the endorsement dated 12.09.2016, the land belongs to Gramakantam, as such if any action has to be taken against the petitioners, the respondents shall follow due process of law. There shall be no order as to costs.
