HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.42976 OF 2016 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is preferred by the petitioner seeking to direct the respondents 2 and 3 not to mutate or alter any entries in the revenue records in respect of (1) D.No.458/1 admeasuring Ac.1.00 cents (2) D.No.22/2 admeasuring Ac.1.00 cents (3) D.No.199/D admeasuring Ac.1.35 cents situated at Venkatapalem Village, Tulluru Mandal, Guntur District.

Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Revenue for respondents 1 to 3. With their consent, the writ petition is disposed of at the stage of admission itself. There is no necessity to put respondents Nos.4 and 5 on notice since this Court is not venturing to adjudicate the case on merits.

Though various grounds are raised in the writ petition, learned counsel for the petitioner restricts his prayer seeking a direction to respondents 2 and 3 to follow due process of law if they intend to mutate the names of 4th and 5th respondents in revenue records.

Learned AGP also submits that any changes in revenue records would be only after following due process of law. Having regard to the rival submissions made, the Writ Petition is disposed of directing the respondents to follow due process of law, which includes hearing the petitioners as well as unofficial respondents herein, in case they intend to mutate the

names of respondents 4 and 5 in revenue records. In case, if mutation is already done, the petitioner is at liberty to avail the remedies available under law.
