HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.6668 of 2004 ORDER:

This writ petition is filed by the petitioner seeking his absorption in any suitable post as displaced employee of private bus bearing No.AAV 1347, which was plying on the route Vizianagram to Shikaru Ganji, as per additional guidelines No.3 dated 07.05.1988 and sought a direction to the respondents to absorb him in any suitable post.

Heard Mr.M.Srinivas learned counsel for petitioner and the learned Standing Counsel for Corporation.

It has been contended by the petitioner that he was working as a Conductor on the route Shikaru Ganji to Vizianagaram in Bus bearing No.AAV 1347 owned by one Mr.P.P.A.Rama Raju, which was valid upto 12.11.1986. As the said route was Nationalized, the respondents have taken a decision to provide alternate employment for such of those employees, who have lost their employment because of nationalization of some routes. Learned counsel for petitioner submits that the petitioner is fully eligible and qualified for appointment in any suitable post and therefore, appropriate orders may be issued to the respondents to consider the case of petitioner for appointment in any suitable post under displaced persons quota.

Learned Standing Counsel submits that there is a ban on recruitment and therefore, the case of the petitioner cannot be considered.

This Court, having considered the rival submissions, is of the considered view that the writ petition can be disposed of by directing the petitioner to submit a representation before the respondents within two weeks from the date of receipt of a copy of this order. Upon such representation being received, the respondents shall consider and pass appropriate orders within four weeks thereafter in accordance with law.

With the above observations, the writ petition is accordingly disposed of. No order as to costs.
