Heard learned counsel for the petitioner and learned Government Pleader for the respondents.
2. The petitioner is a Fair Price Shop Dealer of Shop No.93 of Bhavani Nagar, Malkajigiri, Ranga Reddy District. The authorization is valid up to 31.03.2016. While so, on 25.05.2015 the 3rd respondent inspected the shop and recorded that the authorized dealer is conducting the business, in serial No.E of the inspection report and obtained the signature of the petitioner also. But surprisingly, the 2nd respondent passed an order on 27.05.2015 suspending the authorization of the petitioner on the ground that the shop is being run by a benami person instead of the original authorized dealer. This prima facie appears to be at variance to the report prepared by one P. Vijay Babu, UDCI, Circle III (3rd respondent) on 25.05.2015 when he inspected the shop. In the circumstances, the impugned order of the 2nd respondent dated 27.05.
2015 to the extent of suspending the authorization of the petitioner is set aside. However, the 2nd respondent can conduct the enquiry with regard to the allegation of running the shop through a benami by name G. Purnachander instead of the original dealer Ms. Sangeeta and complete the same within a period of three months from the date of receipt of a copy of the order.
3. The Writ Petition is accordingly disposed of. Miscellaneous petitions, if any, pending in the writ petition shall stand closed. There shall be no order as to costs. ________________________________ (A.RAMALINGESWARA RAO, J) 10th June, 2015
