HONOURABLE SRI JUSTICE P. KESHAVA RAO WRIT PETITION No.36042 of 2014 ORDER:

Heard the learned counsel for the petitioner as well as the learned Government Pleader for the respondents. The prayer sought in the writ petition is as under: "... to issue writ, order or direction more particularly one in the nature of writ of mandamus declaring the action of the respondents in not conducting any investigation in the case in Crime No.35 of 2014 on the file of the Jadcharla Police Station House registered upon the complaint of the petitioner and not providing police protection to the petitioner herein and the witnesses in the said case in Crime No.

35 of 2014 as illegal, arbitrary, biased and violative of principles of natural justice and fundamental rights guaranteed by the Constitution of India under Article 21 of the Constitution of India, and further direct the respondents to conduct proper investigation in the said case in Crime No.35 of 2014 on the file of the Jadcharla Police Station House by framing proper section of laws under Sections 120-B, 307, 324 and 364 of Indian Penal Code and to provide police protection to the petitioner and the witnesses in the said case in Crime No.35 of 2014." Learned Government Pleader placed on record written instructions, dated 29.11.2014 issued by the Sub-Inspector of Police, Jadcherla Police Station, Mahabubnagar District.

From a perusal of the said written instructions, it is revealed that after completion of investigation, a charge sheet was filed before the Judicial Magistrate of First Class, Jadcherla on 14.11.2014. After taking cognizance of the offence, the matter was taken on file as C.C.No.41 of 2015 and is pending trial. The next date of hearing is 10.02.2020. In that view of the matter, this Court is of the opinion that no further cause would survive in the writ petition and the same is liable to be closed.

Accordingly, the writ petition is closed. No order as to costs.
