HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 15811 of 2004 ORDER:

This writ petition is filed seeking to issue a writ of mandamus declaring the action of the respondents 3 and 4 in issuing the proceedings dated 07.07.2004 removing the petitioner from services of SVS Medical College as Tutor, as illegal and arbitrary. A consequential direction is also sought to the respondents 23 and 4 to continue the petitioner in service as Tutor with all attendant benefits. When the matter is taken up for hearing, learned counsel for the petitioner submits that the petitioner has attained the age of superannuation during pendency of the writ petition and, therefore, the cause in the writ petition does not survive. In view of the said submission, the writ petition is dismissed as infructuous. Consequently, miscellaneous petitions, if any, pending in the writ petition shall stand closed.
