THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.2482 OF 2016 ORDER:

This Criminal Petition is filed under Section 482 of Code of Criminal Procedure (Cr.P.C.) to quash the proceedings in C.C.No.127 of 2015 on the file of the Judicial First Class Magistrate at Adoni, Kurnool District, arising out of offences under Section 498-A IPC and Sections 3 and 4 of the Dowry Prohibition Act. Heard and perused the material available on record. The Court below has taken cognisance of the case and numbered as C.C.No.127 of 2015. Thereafter, the Court below by order dated 07.04.2015 took cognizance of the complaint only against the husband of the complainant and directed the Section to number the case as C.C.No.158 of 2015. Hence, learned counsel for the petitioners prays this Court to quash the proceedings against the petitioners herein.

Considering the facts and circumstances, this Court is of the view that the petitioners are given liberty to file an application raising all the grounds seeking discharge and the Court below is directed to consider the application on hearing the petitioners and on perusing the records and pass appropriate orders in accordance with law. Till then, the presence of the petitioners is dispensed with before the Court below.

The Criminal Petition is accordingly disposed of. Consequently, miscellaneous petitions, if any, pending, shall stand closed. _____________________ JUSTICE RAJA ELANGO 25.02.2016 pln
