HON'BLE SRI JUSTICE R. KANTHA RAO Writ Petition No.6900 of 2015 ORDER:

Heard the learned counsel appearing for the petitioner and the learned Government Pleader for Civil Supplies (AP).

2. This writ petition is filed seeking Writ of Mandamus declaring the action of respondents 1 to 5 in not taking any action against the 6th respondent for his illegal activities and committing various offences relating to Essential Commodities Act, IPC provisions and other allied control orders issued by the Government and not preventing him from committing repeated offences and not taking action on the petitioner's representation dated 04.02.2015, as illegal and arbitrary.

3. It is submitted by the learned counsel appearing for the petitioner that the petitioner is an agriculturist. After harvesting the paddy crop, the agriculturists in their area, have to send the same to the Rice Millers for the purpose of producing rice. But the rice millers have been supplying poor quality of rice and thereby cheating the poor agriculturists. When this was questioned by the agriculturists, the 6th respondent would come in to the picture and threaten them with dire consequences. Further, the 6th respondent is purchasing PDS rice from various MLS points and diverting it to the black market. It is further submitted that with the afore mentioned allegations, the petitioner submitted a representation dated 04.02.2015 to Respondents 1 to 5, but no action so far has been taken against the 6th respondent.

Having regard to the facts and circumstances of the case, Respondents 1 to 5 are directed to make an enquiry in to the representation dated 04.02.2015 of the petitioner and take appropriate action against 6th respondent, in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order.

5. The writ petition is accordingly disposed of. Pending miscellaneous
