THE HON'BLE SRI JUSTICE P. NAVEEN RAO WRIT PETITION No.37256 OF 2016 ORDER:

This Writ Petition is filed for the following relief: ".. to issue a Writ, order or Direction, more particularly one in the nature of Writ of Mandamus, declaring the action of the 2nd and 3rd respondents in not taking any action against the unauthorized construction made by the 4th and 5th respondents by erecting the gate and constructing a ramp in PlotNo.17 in Sy.Nos.6, 7, 9 and 10 situated at Almasguda Village, Saroornagar Mandal, Ranga Reddy District against to the approved layout by occupying the left over land abutting to petitioners house as illegal, arbitrary, against the building regulations and rules and iolation of principles of natural justice and consequently direct the respondents 2 and 3 to stop the unauthorised construction of the gate towards the northern east corner in plot No.17 in Sy.Nos.6, 7, 9 and 10 situated at Almasguda Village, Saroornagar Mandal, Ranga Reddy District, and pass such other or further orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."

Learned Standing Counsel for respondents 2 and 3, on instructions, would submit that as of now no gate is erected by respondents 4 and 5.

In view of the said submission, learned counsel for the petitioners submits that the petitioners have no interest in prosecuting the Writ Petition at this stage and seeks permission of the Court to withdraw the Writ Petition with liberty to the petitioners to challenge the grant of permission for erection of gate,

as and when such permission is granted by the respondent authorities.

Permission is accorded.

The Writ Petition is accordingly dismissed as withdrawn with the liberty to the petitioners as sought for by them. There shall be no order as to costs.

Miscellaneous petitions, if any, filed in this Writ Petition shall stand closed.
