THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.9397 OF 2016 ORDER:

This Writ Petition is filed challenging the memo No.12/2016 dt.27.02.2016 issued under Section 7 of the A.P. Land Encroachment Act, 1905.

Learned counsel for the petitioner submits that only six days time is granted for submitting explanation, and if more time is granted, petitioner will be able to submit his explanation to the impugned show cause notice. He also states that even before petitioner could file his explanation, respondents are trying to evict the petitioner from the subject land.

Normally this Court will not interfere with the show cause notice, unless the same is without jurisdiction.

4. But, in the circumstances of the case, petitioner is granted two

(02) weeks time from today to submit his explanation to the impugned notice dt.27.02.2016. After expiry of the said period, it is open for the respondents to pass final orders pursuant to the impugned show cause notice, after considering the explanation, if any submitted by the petitioner, and also after giving a personal hearing to the petitioner. Till such final orders are passed, status quo obtaining as on today shall be maintained by both the parties, in the subject property.

5. With the above observations, the Writ Petition is disposed of. There shall be no order as to costs.

6. Consequently, miscellaneous petitions, if any, pending, shall stand closed.
