THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION Nos.12423 OF 2023 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by the petitioner/Accused No.7 seeking bail in the event of his arrest in connection with Crime No.331 of 2023 on the file of Adilabad II Town Police Station, Adilabad District, registered for the offences under Sections 337, 447, 307 and 109 r/w. 34 of IPC.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent-State and perused the record.

The complaint was filed by the de-facto complainant alleging that he was beaten with bats by A-1 and others. It is alleged that the said threatening and beating of A-1 was at the instance of this petitioner, who is the Director of RIMS hospital. 4.
As seen from the remand report of A-1, it is stated that A-7 asked A-1 to threaten the de-facto complainant. However, the altercation ensued, in which the de-facto complainant received injuries.

Since the disputes appears to be in hospital premises and also the petitioner had not caused any juries, the relief of
anticipatory bail can be considered, subject to following conditions:-
1) The petitioner/Accused No.7 is directed to surrender before the Station House Officer, Adilabad II Town Police Station, Adilabad District, on or before 27.12.2023. Upon such surrender, the said Station House Officer shall release the petitioner/Accused No.7 on bail, on his executing personal bond for a sum of Rs.50,000/- (Rupees Fifty Thousand only) with two sureties, for a like sum each to his satisfaction.
2) On such release, the petitioner/Accused No.7 shall appear before the concerned Station House Officer for the purpose of investigation at 10:00 a.m. on every Monday for a period of eight weeks and thereafter, as and when required.
3) The petitioner/Accused No.7 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
