THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.13591 of 2025 ORDER:

Seeking the Court to enlarge the petitioner-accused in Crime No.496 of 2025 of Panjagutta Police Station, Hyderabad, on bail, the present petition is filed.

The brief facts of the case are that, on 29.06.2025, de-facto complainant lodged a report with the police stating that, his sister who married the accused in December 2023, was subjected to frequent physical abuse. Despite family interventions, the accused continued to assault her. Around 20 days prior to the incident, she complained of stomach pain and was brought to her parental home for treatment. After returning to her marital home, she was again assaulted and forced out by the accused and his mother. On 29.06.2025, she experienced severe stomach pain and was taken to multiple hospitals, where doctors at NIMS declared her brought dead at 19:10 hrs. The complainant suspects that her death was caused by the accused and his relatives, who allegedly gave her unhygienic water, leading to her deteriorating health. Based on the complaint, Crime No.496 of 2025 was registered under Section 80 of the Bharatiya Nyaya Sanhita (BNS).

Heard Sri M.V.V. Baswaraj, learned counsel appearing on behalf of the petitioner as well as Sri Arun Kumar Doddla, learned Additional Public Prosecutor appearing on behalf of the respondent-State.

Learned counsel for the petitioner submitted that the petitioner is innocent of the alleged accusations and, at the time of the incident, the deceased was residing at her parents' house and that an earlier bail petition was dismissed due to non-receipt of the Post-Mortem Examination (PME) report, which remains pending and is crucial to ascertain the cause of death. He further submitted that the petitioner has been in judicial custody since 12.09.2025, and the substantial part of the investigation is completed and further detention of the petitioner is unnecessary. Therefore, he prayed the Court to grant bail to the petitioner by allowing this criminal petition.

On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioner, contending that the allegations against the petitioner are serious in nature and the investigation is still in progress, granting bail at this stage may lead to tampering with evidence or intimidation of witnesses and further submitted that the PME

report is yet to be received. Therefore, he prayed the Court to dismiss the criminal petition.

In the light of the submissions made by both the learned counsel and upon perusal of the material available on record, it is noted that the petitioner has been in judicial custody since 12.09.2025.

Despite the incident occurring in June, the Investigating Officer has yet to collect the Post-Mortem Examination (PME) report. Considering the overall facts and circumstances of the case including the nature of the allegations, the duration of incarceration, the stage of investigation, this Court finds it just and proper to grant bail to the petitioner, subject to the following conditions:

i.

The petitioner shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties for a like sum each to the satisfaction of the learned XIV Additional Chief Judicial Magistrate, Nampally, Hyderabad.

ii.

The petitioner shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) week or till filing of charge sheet whichever is earlier,

for the purpose of investigation, and thereafter, as and when required.

iii.

The petitioner shall abide by the conditions stipulated in Section 437(3) of Cr.P.C.

(presently, Section 480(3) of the BNSS).

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
