This writ petition is filed seeking writ of mandamus declaring the inaction of the 2nd respondent in receiving and registering the sale deed to be presented by the petitioner in respect of agricultural dry lands of an extent of Acs.7.29 gts, situated in Sy.No.118, the then Ramannapet Taluq, presently Choutuppal Village and Mandal, Nalgonda District, as illegal and arbitrary and consequently to direct the 2nd respondent to receive and register the sale deed to be presented by the petitioner in respect of subject property.

Heard learned counsel for the petitioner and learned Assistant Government Pleader for Revenue.

The grievance of the petitioner is that the 2nd respondent is refusing to receive and register the sale deed presented by him in respect of the subject land.

Counter affidavit is filed by the 2nd respondent stating that the subject land is assigned land as per the list furnished by the Mandal Revenue Officer, Choutuppal and that for registration of such lands, the petitioner has to approach District Collector for permission.

Learned Assistant Government Pleader for Revenue also submits that petitioner has to approach the District Collector.

In view of the same, this writ petition is disposed of granting liberty to the petitioner to make an application to the concerned District Collector and on such application; the District Collector shall consider the same and pass orders in accordance with law.

There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in this writ petition, shall stands dismissed.
