THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.2252 OF 2016 ORDER:

This petition is filed by the petitioners-A1 to A5 under Section 482 Cr.P.C. seeking to quash the proceedings against them in C.C.No.9 of 2015 on the file of the II Additional Judicial Magistrate of First Class, Madanapalle.

The petitioners are alleged to have committed the offence punishable under Sections 341, 323 and 506 r/w 34 IPC. It is alleged that the son of the de facto complainant is studying ECE Branch in MIT's Engineering college and on 25.9.2010 when he parked his vehicle at some place within the college premises, the security guard abused him and the petitioners punished him to stand from 9.10 a.m., to 1.30 p.m., and again on 27.9.2010 the petitioners beat him and warned him that they will not give marks to him and they will give bad conduct certificate and they insisted him to write a letter as per their dictation and necked out him.

Considering the facts and circumstances of the case and the nature of the allegations, this Court is not inclined to grant the relief sought by the petitioners.

At this stage, the learned Counsel for the petitioners prayed for dispensing with the presence of the petitioners before the trial Court. In view of the above submission, the presence of petitioners-A1 to A5 before the trial Court is dispensed with except on the date of framing of charges, on the date of their examination under Section 313 Cr.P.C., on the date of the judgment and on the dates when their presence is insisted by the trial Court. The petitioners shall be represented by their Counsel in the above C.C. on all hearing dates. With the above directions, the Criminal Petition is disposed of. Consequently, miscellaneous petitions pending, if any, shall stand closed.
