THE HON'BLE SRI JUSTICE S.V. BHATT W.P.No.1674 OF 2013 ORDER:
Heard Smt.G.V.Bhagya Lakshmi for petitioners. The petitioners claim to be in settled possession and enjoyment of houses at Kodurupadu Village by the side of Kurthipalem Canal, SPSR Nellore District.
In support of petitioners' construction of houses, temporary or permanent and actual enjoyment, they have placed on record Ex.P-2 photographs.
This Court, on 24.01.2013, granted the following relief. "Notice before admission.
Pending further orders, respondents are directed not to take any steps for demolition or dispossession of the petitioners from their residential houses, for a period of four weeks. Post after two weeks".
The interim order was extended by order dated 07.02.2013 and the same is subsisting till date.
Respondents have neither filed counter affidavit nor sent instructions to learned Government Pleader.
I am satisfied, having regard to the limited prayer of petitioners, the writ petition can be disposed of by this order. The interim order granted on 24.01.2013 is made final order in the writ petition. The petitioners, if so advised, are given liberty to
represent to 3rd and 4th respondents for appropriate reliefs in this behalf. It is needless to observe that if respondents 1 and 2 in the process of administering the canals or protecting the bunds desire to take any action against petitioners, the same shall be in accordance with law.
The writ petition is disposed of as indicated above. There shall be no order as to costs.
Consequently, pending miscellaneous petitions, if any, stand closed.
