Sri. Kurapati Jacob Raju, v. The State Of Telangana,
HIGH COURT OF JUDICATURE AT HYDERABAD FOR THE STATE OF TELANGANA AND THE STATE OF ANDHRA PRADESH PRESENT THE HON'BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA AND THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION NO.7292 OF 2015 DATED:20.3.2015 Between:
Sri Kurapati Jacob Raju ... Petitioner And The State of Telangana Rep. by its Principal Secretary to Government General Administration Department T.G. Secretariat Hyderabad and others ... Respondents
THE HON'BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA AND THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION NO.7292 OF 2015 ORDER: (per the Hon'ble The Chief Justice Sri Kalyan Jyoti Sengupta) This writ petition is filed praying for the following reliefs: "...to declare the action of the 2nd respondent in respect of (1) not considering the representation, dt.05.03.2015 for conducting the elections on any day of the week except Sunday, (2) Timings for voting may be extended from 4 pm to 6 pm, pursuant to the Circular No.145/Elections/GHMC/2015, dt.11.02.2015 and scheduled to be held on 22.03.2015, vide G.O. RT. No.821, dated 14.03.
2015 Biennial Election to Mahaboobnagar, Ranga Reddy, Hyderabad Graduates Constituency in Telangana State, as illegal, arbitrary, biased, unconstitutional, against the principles of natural justice and against the Rules of "People's Representation Act" and consequently direct the respondents to conduct the election on any day of the week except Sunday and the timings for voting may be extended from 4 pm to 6 pm, and to pass other order or orders or directions as this Hon'ble Court may deem fit and proper in the circumstances of the case." We really wonder how this sort of relief can be asked for before Court of law. For benefit of one individual entire election process cannot directed to be conducted according to his own wish. Therefore, the writ petition is frivolous and is dismissed with costs assessed at Rs.
500/- (Rupees five hundred only).
Pending miscellaneous petitions, if any, shall also stand dismissed.
