No.1 of 2025 (For being mentioned) This petition is filed by the petitioner-appellant under the caption 'for being mentioned' for clarification permitting the petitioner-appellant to withdraw the amount of enhanced compensation as per the order and decree passed in MACMA No.938 of 2008 dated 13.12.2023, deposited by the respondent No.3 to the credit of MVOP No.88 of 2006 on the file of learned I Additional District Judge (MACT), Karimnagar.

Heard the learned counsel for the petitioner. Learned counsel for the petitioner submitted that this Court vide order dated 13.12.2023 in MACMA No.938 of enhanced the compensation amount from Rs.1,00,000/- to 7,13,302/- with interest @ 7.5% per annum on the enhanced amount. Pursuant to the said order, the respondent No.3-Insurance Company deposited an amount of Rs.15,77,023/- with interest to the credit of MVO.P No.88 of 2006 on the file of learned I Additional District Judge (MACT), Karimnagar.

He further submitted that they have filed an interlocutory application in the said MVOP No.88 of 2006 on 03.01.2025 with a prayer to permit them to withdraw the entire deposited amount as per the order of this Court passed in MACMA No.938 of 2008 dated 13.12.2023. But the said application was returned with an objection that

there is no order permitting withdrawal of the amount in the said MACMA.

Considering the submissions of the learned counsel for the petitioner and considering the reasons stated in the accompanying affidavit, this petition is allowed and the petitioner is directed to withdraw the amount deposited by the respondent No.3-Insurance Company, without furnishing any security.
