THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 20999 of 2016 ORDER:

The grievance of the petitioner in this writ petition is that pending consideration of the proceedings under Section 6-A of the Essential Commodities Act, 1955 (for short, 'the Act'), the respondent authorities are proposing to dispose of the stocks seized from it. Learned counsel for the petitioner submits that inasmuch as the petitioner is ready and willing to furnish a third party security for the value of the stocks, they may be released in its favour. He requests this Court to fix the time limit for completion of the proceedings under Section 6-A of the Act.

Learned Government Pleader for Civil Supplies (Telangana) is fair enough in submitting that the respondents will complete the inquiry under Section 6-A within two months.

Having regard to the said submissions, this Writ Petition is disposed of directing the respondents to complete the proceedings initiated against the petitioner under Section 6-A of the Act, within two months from the date of receipt of a copy of this order. It is made clear that pending inquiry, stocks seized from the petitioner shall not be sold. If the petitioner offers a third party security for the value of the seized stock, the respondents may consider releasing the same in its favour. No costs.

Consequently, the Miscellaneous Applications, if any shall also stand disposed of.
