As there was no representation for the appellant twice on 04.02.2016 and 08.02.2016, the matter was directed to be listed under the caption "FOR DISMISSAL" on 09.02.2016.

2. Even today, despite the matter being listed under the caption "FOR DISMISSAL", there is no representation for the appellant. It appears that the appellant is not interested in pursuing the matter.

3. Accordingly, the Civil Miscellaneous Appeal is dismissed for non-prosecution. Interim stay granted by this Court on 01.07.2005 is vacated. As a sequel, miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs.
