THE HON'BLE SRI JUSTICE RAMESH RANGANATHAN AND THE HON'BLE SRI JUSTICE M.GANGA RAO WRIT PETITION NO.30122 OF 2018 ORDER: {Per the Hon'ble Sri Justice Ramesh Ranganathan} The order, under challenge in this Writ Petition, is the order passed by the Debts Recovery Tribunal, Visakhapatnam in S.A.No.158 of 2018 dated 09.07.2018. Against the said order, the petitioner has an efficacious alternative statutory remedy of appeal to the Debts Recovery Appellate Tribunal without availing which they have invoked the extraordinary jurisdiction of this Court under Article 226 of the Constitution of India. As the petitioner has an alternative remedy of a statutory appeal, we see no reason to exercise discretion, under Article 226 of the Constitution of India, to interfere.

Leaving it open to the petitioner to avail the remedy of an appeal, the Writ Petition fails and is, accordingly, dismissed. There shall be no order as to costs. Miscellaneous petitions, if any, pending shall stand dismissed.
