THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN AND THE HON'BLE SRI JUSTICE P.NAVEEN RAO CONTEMPT CASE NO.805 OF 2017 ORDER: {Per the Hon'ble the Acting Chief Justice Ramesh Ranganathan} The order, violation of which is alleged in this Contempt Case, was passed in WP.No.21383 of 2016 dated 01.07.2016 wherein the submission of the learned Government Pleader, appearing on behalf of the learned Advocate General, was recorded that, till the next date, respondents would not regularize the contract lecturers as per the amended provisions contained in Section 10-A of the A.P. Public Employment (Regulation of Appointments to Public Services and Rationalization of Staff Pattern and Pay Structure) Act, 1994.

In the counter affidavit filed by the Commissioner of Technical Education dated 21.06.2017, it is stated that the entire correspondence was only a process being completed to keep the proposals ready in full and accurate shape so that, based on the Court orders and overall policy of the Government, final orders, regarding regularization of these employees, could be issued in future;

the memo dated 03.04.2017 was an internal correspondence in this regard between the departments, and no regularization orders have been issued by the Technical Education Department to any contract lecturer so far; and the allegation that the respondents had violated the order in WP.No.21383 of 2016 dated 01.07.2016 is not correct.

As no orders of regularization have been issued by the respondents, the undertaking given by them to this Court, as

recorded in the order in WP.No.21383 of 2016 dated 01.07.2016, cannot be said to have been violated. We see no reason to proceed against the respondents under the Contempt of Courts Act, 1971. The Contempt Case is, accordingly, closed.
