HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.6152 OF 2017 ORDER:

The case of the petitioners is that they have filed Revision under Section 9 of the A.P.Rights in Land and Pattadar Pass Books Act, 1971 before the Joint Collector, Nirmal District on 22.11.2016 against the order dated 24.09.2016 in proceedings No.B/122/2016. In pursuant to the same, notice dated 08.01.2017 was issued, fixing the date of hearing on 24.01.2017. The grievance of the petitioner is that the Revenue Divisional Officer who passed the order dated 24.09.2016 is promoted as Joint Collector, Nirmal, as such, he cannot decide the Revision against his own orders and the same has to be transferred. Hence, the present writ petition is filed.

Heard the learned counsel for the petitioner. Learned Assistant Government Pleader for Revenue on instructions submits that as the 3rd respondent cannot decide the Revision against his own orders, a direction may be given to the 3rd respondent to transfer the same to the 2nd respondent. In view of the above facts and circumstances, the 3rd respondent is directed to transfer the said Revision to the 2nd respondent and on receipt of the same, the 2nd respondent is directed to dispose of the same, in accordance with law, after issuing notice to the petitioner as well as to the parties to Revision. The said exercise shall be done within a period of three

(03) months from the date of receipt of copy of this order.

With the above direction, the writ petition is disposed of. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
