HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.29703 OF 2017 ORDER:

The action of respondent No.3 in registering FIR.No.57 of 2017, at the instance of respondent No.4, is questioned in the Writ Petition as being illegal and arbitrary. The prayer in the writ petition is innocuous. Even, as per the petitioners, crime was registered at the instance of respondent No.4. The contents of the First Information Report itself disclose commission of cognisable offence, and number of crimes have been registered against various individuals including the petitioners herein.

In the circumstances, the Writ Petition is disposed with a direction to respondent Nos.2 and 3 that investigation into the cases filed against the petitioners and others shall be carried out strictly in accordance with the procedure prescribed, and necessary steps be taken in accordance with the Criminal Procedure Code.
