HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.34686 OF 2016 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, has been preferred by the petitioner seeking the following relief:

" .... to issue a writ, order or direction more particularly one in the nature of writ of MANDAMUS declaring the action of the respondent No.1 & 2 in not considering the representations dt.09-01-2015, 31-01-2015 and 2407-2015 issued by Respondent No.3 pursuant to the letter addressed by the petitioner on 05-01-2015 to respondent No.3, for survey and demarcation/fixing the boundaries of the land in respect of the extent of Ac.140-00 gts., in Sy.No.80 of Hafeezpet Village, Sherlingampally Mandal, R.R.

District is illegal, Arbitrary, contrary to law and unconstitutional and further violative of Article 14, 21 of Constitution of India and further violative of principles of natural justice and consequently direct the respondent No.1 & 2 to conduct survey and demarcation of above said land and pass such other relief or relief's as this Hon'ble court may deem fit and proper in the circumstances of the case."

Heard the learned counsel for the petitioner, the learned Government Pleader for Revenue (TG) for respondents 1 and 2 and Sri S.Arifullah, learned Standing Counsel for 3rd respondent. With their consent, the writ petition is disposed of at the stage of admission itself.

It is the case of the petitioner that he made a representation to the 3rd respondent on 05.01.2015 seeking to conduct a joint survey. Pursuant thereto, the 3rd respondent addressed a letter

dated 31.01.2015 to the 2nd respondent requesting for joint survey. However, till date no survey was conducted. Hence, the present writ petition.

Having heard the rival submissions made, the Writ Petition is disposed of directing the 2nd respondent to dispose of the representation dated 05.01.2015 made by the petitioner for conducting survey, in accordance with law, as early as possible, preferably within a period of six weeks from the date of receipt of a copy of this order.
