Heard learned counsel for the petitioner and the learned counsel for the sixth respondent.
The petitioner was appointed as Attender in the sixth respondent temple on contract basis initially. His contract was being renewed from time to time and his services were regularized in the year 2011. While so, he was suspended from service by order dated 28.04.2017 on the ground that the petitioner was shown as fifth accused in crime No.39 of 2017 by the Kowthalam Police Station. Challenging the suspension order, the present writ petition is filed.
An application is filed to take the petitioner into service since six months period was completed. The learned counsel appearing for the sixth respondent submits that the petitioner was taken into service on 13.11.2017. However, with regard to criminal case pending against the petitioner, the same can go on according to law. An enquiry officer was appointed on 28.07.2017 to enquire into the mater and submit a report in order to take further action. As on 11.09.2017, the enquiry was stated to be pending.
In the circumstances, the writ petition is disposed of directing the fifth respondent to complete the enquiry and pass appropriate orders in accordance with law as expeditiously as possible. Consequently, miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs.
